Mr. Benimovich handles all matters relating to the Department of Buildings (“DOB”) including construction site safety, equipment safety, crane safety, SRO and transient use/short term stay. He also handles Fire Department (“FDNY”), DEP and Sanitation Matters, as well as criminal summonses issued by the DOB, FDNY and other agencies within the SAP2 Part of Criminal Court.
Building on his City experience, Mr. Benimovich brings extensive knowledge, insight, and experience when defending clients on violations and summonses in hearings before the Office of Administrative Trials and Hearing (also known as OATH Hearing Tribunal or the ECB) and in representing clients on related regulatory matters including those in the Housing Court.
Mr. Benimovich was an attorney for the City of New York from 2016 to 2019. Mr. Benimovich worked in the DOB’s Administrative Enforcement Unit where he represented the City before the OATH Hearing Tribunal (the ECB) on thousands of matters. In Mr. Benimovich’s time with the city, he shared responsibility for the cutting edge advances in areas of Construction Site Safety as well as Transient Use Law. He was responsible for appeals addressing Occupancy Violations involving both the use and/or conversion of a premise, Construction Violations involving Cranes, matters concerning Plumbing/Rigging and other licensed professions as well as a variety of other matters.
Mr. Benimovich also represented the city on numerous high profile cases involving fatalities, issues of first impression, and cases involving significant media attention. During his time working for the City of New York, Mr. Benimovich assisted the DOB’s AEU in reviewing Certificates of Corrections, and following his time with the City, he has continued to counsel and advise on issues involving corrections of violations and summonses such as the hidden costs of receiving a violation from the city, including civil penalties, license renewal and the costs of the corrective work.
Prior to working for the City, Mr. Benimovich worked for Brooklyn Legal Services, specializing in Student Loan Debt Forgiveness and Foreclosures. Mr. Benimovich served on the Board of Director for the Civil Service Bar Association, the union representing City Agency Attorneys.
Mr. Benimovich is a licensed New York attorney, admitted to practice in all New York Courts. Mr. Benimovich earned his Juris Doctorate from Benjamin N. Cardozo School of Law, and previously graduated at the top of his class with a Bachelor’s degree in Economics from Baruch College.
